ThisWay at Work terms
The terms for organisations that buy ThisWay at Work, so their employees can use ThisWay services for free. These are business terms: individual members have their own terms of membership.
In short
- £6 per employee a year, with a minimum of £2,500 a year, plus VAT. One licence covers every ThisWay service that's open.
- You get access codes, a manager guide and anonymised uptake numbers. You never see who uses ThisWay or anything they tell us.
- Licences last 12 months and don't renew automatically. We remind you 60 days before the end.
About these terms
These terms are between OCCO Wellbeing Ltd, trading as ThisWay (company number 13518404, registered office 369 Hagley Road West, Quinton, Birmingham, England, B32 2AL) and the organisation buying ThisWay at Work ("you"). The person accepting them confirms they're authorised to do so for your organisation. Contact: employers@thisway.health.
ThisWay at Work goes on sale in spring 2027. Until then, registering interest doesn't commit you to anything.
What you get
- Access codes for the number of employees in your order. Each code gives one person full membership of every open ThisWay service, including a partner pass where the service offers one, for the length of your licence.
- A manager guide on supportive conversations and reasonable adjustments.
- An anonymised uptake report, which you can use in a menopause action plan or wellbeing report.
- Self-serve setup: buy, share codes and renew online.
You decide who gets a code. Codes are for your employees (and, if you choose, workers and contractors) in the UK, aged 18 or over. Please don't sell codes or give them outside your organisation.
Your people's privacy
This is the heart of ThisWay at Work, so it can't be changed by agreement:
- We never tell you who has used a code, or anything about anyone's health, answers or record.
- Your report only shows anonymised totals, such as how many codes have been activated and which services are being used. We never report a number for fewer than ten people, so nobody can be identified.
- Each member has a direct relationship with ThisWay, under our terms of membership and privacy notice. For their membership, OCCO Wellbeing Ltd is the controller of their data, not your organisation.
- You mustn't ask employees whether they use ThisWay, or ask them for anything from their record, and you mustn't make using ThisWay a condition of anything at work.
For your own contacts' details (the people who buy and manage the licence), each of us is a separate controller, and we'll use them as our privacy notice explains.
Price and payment
- £6 per employee a year, with a minimum of £2,500 a year, plus VAT at the standard rate.
- You pay in advance for the 12-month licence, by card online or, for orders over £5,000, by invoice payable within 30 days.
- You can add codes during a licence at the same annual rate, charged pro rata for the rest of the licence year.
- We may charge statutory interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998. We may pause the issue of new codes while an invoice is overdue, but we'll never switch off codes already activated by your employees during a paid licence.
Length, renewal and ending
- Licences last 12 months from the start date in your order.
- They don't renew automatically. We'll remind you 60 days before the end, with the renewal price.
- If you don't renew, members who joined with your codes keep access until the end of your licence, then can choose to pay themselves or move to the free plan. We'll tell them in good time, without telling you who they are.
- Either of us can end the licence if the other seriously breaks these terms and doesn't put it right within 30 days of being asked in writing. If we end it because we're closing ThisWay at Work, we'll refund the unused part of your fee.
- There's no refund if you end the licence early for any other reason, but your employees' codes keep working until the end of the paid licence.
Our promises
We'll provide ThisWay with reasonable care and skill, keep it available except for maintenance and events outside our control, protect personal data as UK data protection law requires, and keep content independent, evidence-based and up to date as set out in our editorial and evidence policy.
ThisWay gives general information and signposting. It isn't medical or occupational health advice, doesn't replace your occupational health service, employee assistance programme or legal duties as an employer, and can't be used to assess any employee.
Your promises
You'll pay on time, share codes only as these terms allow, not use our name or logo except to tell employees about ThisWay at Work (using the materials we give you), and not claim ThisWay provides medical advice.
Liability
Neither of us limits liability for death or personal injury caused by negligence, fraud, or anything else that can't be limited by law. Otherwise, neither of us is liable for indirect or consequential loss, or loss of profit, revenue or data, and each party's total liability under these terms in any licence year is limited to the fees paid or payable for that year.
General
- These terms, your order and any documents they refer to are the whole agreement between us.
- We may update these terms for new licences. Changes don't apply to a licence you've already bought unless you agree.
- Neither of us is responsible for delays caused by events outside our reasonable control.
- Nobody else has rights under these terms under the Contracts (Rights of Third Parties) Act 1999, except that your employees' privacy protections above may be relied on by them.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
